Legal guardianship

Legal guardianship comes under National Trust. The differently abled person should be more than 18 years of age.



Who can Apply


1. The natural parent of the person with disability can apply for legal guardianship.

2. If both the parents are not alive or are incapable of discharging the duties of a legal guardian, the application can be moved by the siblings. 

3. In the absence of parents or siblings, any person with disability can apply for appointment as his guardian. 

4. In case a person with disability has neither any parent, sibling or relative, any voluntary organization working in the area of the disabilities covered by the National Trust Act, 19999 and registered with the National Trust under Section 12 of the said Act may apply for guardianship.



How to apply


Application form -A can be downloaded from the website www.thenationaltrust.in. Fill in the form and attach the needed documents and submit before Local Level Committee. The LLC will examine and verify the application in detail. If satisfied they will call for hearing on a specified date. Whenever necessary, the committee may take the help of experts on particular disability and examine or take the help of State Welfare Officers to make a preliminary study of the applicant's situation and that of the person with disability. It may also personally visit the person with disability and examine the actual situation. Upon satisfaction about the needs and purposes of appointment of guardianship, the committee will proceed with the application.
